Terms of Service - Elite Petz LLC

Please read these Terms of Service ("Terms") carefully before using www.elitepetz.com (the “Website”), operated by Elite Petz LLC (“we,” “us,” “our,” or “Elite Petz”). These Terms govern your access to and use of our services, including the purchase, delivery, and care of kittens, and constitute a legally binding agreement.
1. All Sales Are Final - No Returns
All kitten sales through Elite Petz are final. By purchasing a kitten from Elite Petz:

You acknowledge that kittens are sold as-is, in good health, and free from any visible disease at the time of transfer, as verified by a licensed veterinarian.

No refunds, exchanges, or returns are permitted once payment is received and the kitten is reserved.

Buyer confirms their commitment to provide a safe, loving, and suitable forever home for the kitten.
2. Purchase Process and Payment Terms
2.1 Reservation and Prepayment Policy
All purchases of kittens on ElitePetz.com require prepayment, either in full or as a reservation deposit. The standard deposit is 30% of the total price, unless another amount is explicitly agreed upon between the Buyer and the Breeder. The remaining balance must be paid prior to shipment of the pet.
Deposits are essential to secure your chosen kitten, as most are not immediately available for same-day transfer. Kittens must reach the minimum weaning age of 12 weeks, be fully vaccinated, and, in some cases, neutered or spayed before leaving the breeder. Documentation, including health and registration papers, also takes time to process. Therefore, the reservation ensures that the selected pet is exclusively assigned to the Buyer during this preparation period.
Please do not submit a deposit or payment until you have spoken with our team or the breeder directly to confirm the availability, suitability, and timing for receiving the kitten.
2.2 Step One: Reserving Your Kitten
To confirm serious intent, the Buyer places a non-refundable reservation deposit. Once received:

The pet will be marked as “Reserved” and removed from public listings.

The breeder commits to holding the kitten exclusively for the Buyer.
If, after placing a deposit, the Seller is unable to fulfill the sale (e.g., due to illness, injury, or death of the kitten), the Buyer will be offered:
-
A full refund of the deposit, or
-
An equivalent replacement kitten, if available.
However, if the Buyer cancels after the reservation is confirmed, or becomes unresponsive, the deposit is forfeited. This applies regardless of reason, unless specific terms were previously agreed upon in writing.
2.3 Step Two: Final Payment and Pet Shipment
Once the kitten is fully ready to go (health cleared, documents processed, and recovery completed, if spayed/neutered), the Seller will notify the Buyer. At that point:

The remaining balance is due in full before the pet can be shipped.

No kitten will be released or shipped without full payment unless the handoff is happening in person within the same city and such arrangement is mutually agreed upon.
Shipping is coordinated between the Seller and Buyer after final payment is received. ElitePetz.com is not responsible for third-party courier delays or issues once the animal is in transit (see Section 3.2).
2.4 Where and How to Pay
ElitePetz.com offers the option to:

Pay directly on our website, using secure checkout options, or
-
Pay the breeder directly, if preferred and agreed upon.
Important Notice: If payment is made off-site (direct to breeder), ElitePetz.com cannot act as a financial guarantor in the event of disputes. Payments made through our platform offer greater protection and verification.
We highly encourage open communication with us before placing a deposit. Some breeds require specific environments, care experience, or follow-up. Likewise, breeders may have questions for Buyers to ensure the kitten will be entering a safe and prepared home.
If the breeder declines the transaction after payment through ElitePetz.com, a full refund will be issued within 24 hours. Additionally, if the Buyer changes their mind within 24 hours of paying directly on our website, we will refund the deposit, no questions asked. This 24-hour grace period applies only to payments made on the ElitePetz.com platform.
3. Shipping Terms
3.1 Shipping Process
-
Kittens will typically ship within 10–20 days of purchase, once cleared by our veterinarian.
-
The final delivery date is determined at the sole discretion of Elite Petz and in coordination with veterinary guidance.
-
We use third-party services (freight carriers, airlines, licensed agents) for transportation.
3.2 Delays and Limitations
-
Delays may occur due to weather, mechanical issues, airline regulations, or other external factors. These are beyond our control.
-
Elite Petz is not responsible for costs or losses due to delays or flight cancellations.
-
Buyer agrees that shipping fees are non-refundable under all circumstances.
4. Health Guarantee
4.1 Initial Health Status
-
All Elite Petz kittens:
-
Are FeLV (feline leukemia) and FIV (feline AIDS) negative.
-
Are litter trained and introduced to a scratching post.
-
Receive age-appropriate vaccinations and deworming before transfer.
-
4.2 Buyer Responsibility
-
Buyer must take the kitten to a licensed veterinarian within 5 days of delivery for a wellness check.
-
Failure to do so voids all health guarantees.
-
Evidence of abuse, neglect, or improper care also nullifies all guarantees.
4.3 Health Coverage
-
We cover death caused by FIP within the first 6 weeks, provided the condition is confirmed via necropsy by a licensed pathologist.
-
Buyer may be eligible for a 50% store credit for FIP-related death within the following 6 months.
-
-
For congenital or hereditary conditions causing death within the first 12 months, we will offer a replacement kitten (not a refund), based on:
-
A certified necropsy report.
-
Proof submitted within 30 days of the necropsy.
-
-
We cannot guarantee specific color, pattern, or sex in the replacement kitten.
5. Seller Responsibilities
-
We transfer kittens no earlier than 12 weeks of age, fully vaccinated and dewormed.
-
We provide:
-
A veterinary record/passport,
-
Health certificate (for domestic shipments in the U.S. and Canada),
-
Support before, during, and after adoption.
-
We do not guarantee:
-
Show performance,
-
Breeding success (unless breeding rights are granted),
-
Exact adult size, personality, coat color/pattern.
6. Buyer Responsibilities
6.1 Pet Care Obligations
-
Provide proper care: nutrition, indoor shelter, mental stimulation, and veterinary care.
-
Keep the kitten indoors for at least the first year.
-
Prevent exposure to unvaccinated or stray animals.
6.2 Veterinary Exam and Medical Care
-
Must complete a veterinary exam within 5 days of receiving the kitten.
-
Must retain and provide veterinary records if claiming warranty rights.
-
Must not declaw the kitten under any circumstances. Declawing voids all guarantees.
6.3 Vaccinations
-
FIP and leukemia vaccinations are prohibited under our agreement. Reasons include:
-
Low efficacy and high health risks.
-
Risk of fibrosarcoma and long-term immune suppression.
-
-
Buyer agrees to take precautionary measures through safe indoor living conditions rather than relying on these vaccines.
6.4 Transfer Restrictions
-
Buyer may not surrender the pet to a shelter, research lab, or rescue.
-
If rehoming is necessary, the Seller must be contacted first and has first right of refusal.
-
Spaying/neutering is mandatory if breeding rights are not included. Proof must be provided.
7. Breeding Rights and Spay/Neuter Policy
7.1 No Breeding Rights
-
Unless explicitly granted, kittens are sold without breeding rights.
-
Usually the kittens are shipped already neutered. If not the buyer must spay/neuter the kitten by 8 months of age and submit proof within 14 days post-surgery.
-
A veterinary extension may be requested with documentation.
7.2 Breach of Breeding Terms
-
Unauthorized breeding constitutes a material breach of this agreement.
-
Remedies may include:
-
Legal enforcement of sterilization,
-
Purchase of breeding rights post-factum,
-
Liquidated damages per live offspring equal to the base price of the original kitten.
-
7.3 With Breeding Rights (If Granted)
-
Breeding must be conducted ethically with attention to the kitten’s health.
-
The buyer shall not transfer the pet to another person or breeder and/or shall not give/sell breeding rights of the animal's offspring for 3 generations without written consent from Elite Petz.
-
No co-ownership, stud leasing, or resale for breeding purposes is allowed.
8. Refund and Return Policy
8.1 Health-Based Returns
If the kitten is found to be unhealthy at the moment of acquisition, and this is confirmed in writing by a licensed veterinary clinic within five (5) days of receipt, the following applies:

The Seller agrees to accept the return of the animal.
-
The Buyer will receive a store credit equal to the amount paid for the kitten.
-
Shipping costs and any other additional expenses (including veterinary fees, travel, etc.) are non-refundable.
-
The health issue must be deemed serious enough to warrant return, not a minor or treatable condition.
8.2 Buyer Dissatisfaction or External Issues
No refunds, replacements, or credits will be issued in the following circumstances:

Dissatisfaction with the pet’s behavior, personality, or toilet training progress.
-
Discovery of allergies within the household.
-
Theft or loss of the pet.
-
Change of mind after purchase.
-
Preference for a different size, color, gender, or coat pattern.
All sales are final under these circumstances.
8.3 Inability to Keep the Pet
If, at any point in the future, the Buyer is unable to keep the pet for any reason:
-
The Buyer must notify the Seller immediately before making any alternative arrangements.
-
The pet must never be surrendered to a shelter, rescue, or third party.
-
In such cases, the pet should be returned to Elite Petz LLC so we may rehome it appropriately.
-
No refund or compensation will be provided in these cases.
8.4 Shipping Delays
Shipping timelines are estimated. While we do our best to meet the expected timeframes:

Delays due to weather, airline policies, veterinary scheduling, or transport logistics are not grounds for return, cancellation, or refund.
-
The Buyer accepts potential delays as part of the purchase process.
9. Veterinary Passport and Lifetime Guarantee Exceptions
Our lifetime guarantee excludes:
-
Personality or behavioral traits,
-
Exact size or coat appearance,
-
Minor heart murmurs (grades 1–2),
-
Undescended testicles,
-
Failure to spay/neuter,
-
Lack of timely vaccinations or veterinary documentation,
-
Any spaying/neutering procedures themselves.
We cover hip dysplasia for 1 year and do not cover any post-sale elective procedures.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the state of Minnesota, without regard to conflict of law principles.
11. Amendments
Elite Petz reserves the right to update or modify these Terms at any time. Changes will be effective upon posting. Continued use of the site or services after such updates constitutes agreement to the revised Terms.
